Acceptance of Terms

By accessing or using OpenInterview.me ("OpenInterview," "we," "us," "our," or the "Service"), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree to these Terms, do not access or use the Service.

Your use of the Service, including creating a profile, uploading a resume, generating application materials, using AI-assisted features, submitting employment-related information, or interacting with any job application feature, constitutes your acceptance of these Terms.

Eligibility

You must be at least 13 years old to use the Service. If you are under 18, you must have permission from a parent or legal guardian. By using the Service, you represent that you meet these requirements and that your use of the Service is permitted under applicable law.

OpenInterview Is a Technology Platform Only

OpenInterview.me is a technology platform that helps users create professional profiles, upload resumes, generate or organize career-related content, and, where available, transmit employment-related information to third-party employers, recruiters, job boards, applicant tracking systems, or hiring platforms.

OpenInterview is not:

  • An employer.
  • A hiring manager.
  • A staffing agency.
  • An employment agency.
  • A recruiting firm.
  • A recruiter of record.
  • A labor organization.
  • A professional licensing authority.
  • A background screening company.
  • A representative or agent of any employer, recruiter, job board, or hiring platform unless expressly stated in writing.

OpenInterview does not make hiring decisions and does not control any employer's recruiting, screening, interview, compensation, offer, onboarding, or employment process.

All employment-related decisions are made solely by the applicable employer, recruiter, hiring organization, or third-party platform.

No Legal, Career, Employment, Financial, or Professional Advice

Technology Platform Only

OpenInterview.me provides technology tools, automation features, profile creation tools, resume processing tools, AI-assisted content generation tools, informational resources, and communication features designed to assist users with career-related activities.

The Service is provided for informational and convenience purposes only.

Nothing provided through the Service constitutes or should be interpreted as:

  • Legal advice.
  • Employment advice.
  • Career counseling.
  • Recruiting services.
  • Staffing services.
  • Hiring services.
  • Human resources advice.
  • Financial advice.
  • Tax advice.
  • Investment advice.
  • Professional consulting services.
  • Professional advice of any kind.

OpenInterview does not evaluate, endorse, recommend, or guarantee any employment opportunity, employer, recruiter, hiring platform, compensation package, interview strategy, resume format, profile content, application content, or career decision.

Any content generated, suggested, displayed, summarized, reformatted, scored, ranked, recommended, or otherwise produced by the Service, including content generated using artificial intelligence, is provided solely as a convenience tool and should not be relied upon as professional advice.

Users are solely responsible for:

  • Evaluating opportunities.
  • Verifying information.
  • Reviewing generated content.
  • Making employment-related decisions.
  • Determining whether information is appropriate for a particular purpose.
  • Seeking professional advice when necessary.

All decisions made using information obtained through the Service are made solely at the user's own discretion and risk.

Force Majeure

OpenInterview.me shall not be liable for any delay, interruption, failure, degradation of service, loss of data, inability to access the Service, failure of application-related functionality, or other performance issue resulting from causes beyond its reasonable control.

Such events may include, without limitation:

  • Telecommunications failures.

  • Cloud provider outages.

  • Court orders.
  • Civil unrest.
  • Terrorist acts.
  • Public health emergencies.
  • Natural disasters.
  • Floods.
  • Hurricanes.
  • Tornadoes.
  • Earthquakes.
  • Fires.
  • Acts of war.
  • Third-party service interruptions.
  • API failures.

  • Employer platform failures.
  • Applicant tracking system failures.
  • Job board outages.
  • Any other event beyond OpenInterview's reasonable control.

OpenInterview shall have no responsibility or liability for any employment-related consequences, application-related consequences, loss of opportunities, loss of compensation, loss of data, business interruption, or other damages arising from such events.

Performance of OpenInterview's obligations shall be suspended for the duration of the applicable force majeure event and for a reasonable recovery period thereafter.

Electronic Acceptance and Electronic Records

You acknowledge and agree that OpenInterview.me operates as an electronic platform and that actions performed electronically may constitute legally binding agreements.

Without limitation, the following actions may constitute acceptance of these Terms, the Privacy Policy, SMS disclosures, and other policies presented through the Service:

  • Creating an account.
  • Uploading a resume.
  • Creating a profile.
  • Editing a profile.
  • Uploading content.
  • Uploading a video.
  • Clicking buttons.
  • Checking boxes.
  • Selecting consent options.
  • Submitting forms.
  • Initiating applications.
  • Sharing profiles.
  • Purchasing subscriptions.
  • Using AI-assisted features.
  • Continuing to use the Service after notice of updated Terms.

Electronic records, electronic acknowledgements, electronic consents, and electronic acceptances shall have the same legal force and effect as handwritten signatures to the fullest extent permitted by law.

OpenInterview may maintain records of electronic actions, submissions, acknowledgements, consents, profile activity, application activity, and acceptance of Terms for legal, compliance, operational, and security purposes.

A user's creation of a profile, upload of a resume, use of AI-assisted features, submission of employment-related information, clicking of an Apply button, checking of a consent checkbox, or continued use of the Service shall each independently constitute acceptance of these Terms and related policies.

Account Responsibility

You are responsible for maintaining the confidentiality and security of your account credentials and for all activity that occurs under your account.

You agree to:

  • Maintain accurate account information.
  • Keep your login credentials secure.
  • Use reasonable measures to prevent unauthorized access.
  • Notify OpenInterview.me immediately at support@openinterview.me if you believe your account has been compromised.
  • Log out of your account when appropriate.

You are solely responsible for all actions taken through your account, whether authorized by you or not, unless caused directly by OpenInterview's willful misconduct.

OpenInterview.me shall not be liable for any loss, damage, unauthorized access, account misuse, data loss, employment-related consequence, or other harm resulting from your failure to maintain account security.

OpenInterview reserves the right to suspend, restrict, investigate, or terminate accounts that present security concerns, violate these Terms, or create risk to the platform, its users, or third parties.

Profile Content

You retain ownership of the content you post to your profile. By posting, uploading, generating, saving, or publishing content through the Service, you grant OpenInterview.me a non-exclusive, worldwide, royalty-free license to host, display, transmit, reproduce, and use that content as reasonably necessary to operate, provide, improve, and promote the Service.

You agree not to post, upload, submit, or transmit content that is:

  • False, misleading, deceptive, or fraudulent.
  • Infringing on the intellectual property, privacy, publicity, or other rights of others.
  • Defamatory, obscene, harassing, discriminatory, or otherwise unlawful.
  • Containing viruses, malware, malicious code, or other harmful components.
  • Submitted without the necessary rights, permissions, or authorization.

You are solely responsible for your profile content, resume content, application content, and any other information you provide through the Service.

Resume Uploads and Application Materials

The Service may allow you to upload a resume or other career-related documents to help create or complete your OpenInterview profile. You are solely responsible for reviewing all imported, parsed, summarized, reformatted, or generated content before using, publishing, sharing, or submitting it.

OpenInterview does not guarantee that resume parsing, profile generation, application generation, formatting, or content extraction will be accurate, complete, current, or suitable for any particular job opportunity.

You are responsible for verifying the accuracy of all information before submitting it to any employer, recruiter, job board, applicant tracking system, or hiring platform.

AI-Assisted Content

OpenInterview.me may use artificial intelligence, machine learning systems, automation tools, large language models, parsing technologies, recommendation systems, and other automated technologies to assist users with profile creation, resume processing, content generation, interview preparation, application materials, job-related summaries, recommendations, and related features.

Users acknowledge and agree that AI-assisted content:

  • May contain inaccuracies.
  • May contain omissions.
  • May contain outdated information.
  • May be incomplete.
  • May contain formatting errors.
  • May not reflect current employer requirements.
  • May not be suitable for every position, employer, industry, jurisdiction, or circumstance.
  • May produce unexpected, inaccurate, misleading, or undesirable results.

OpenInterview does not guarantee the accuracy, completeness, reliability, legality, suitability, effectiveness, or fitness of any AI-assisted content.

Users remain solely responsible for:

  • Reviewing all generated content.
  • Verifying factual accuracy.
  • Editing generated content.
  • Determining whether generated content should be used.
  • Ensuring compliance with employer requirements.
  • Ensuring compliance with applicable laws and regulations.

OpenInterview does not verify AI-generated content before it is presented to users and shall have no responsibility for any consequences arising from a user's reliance upon, modification of, publication of, sharing of, or submission of AI-assisted content.

To the fullest extent permitted by law, OpenInterview shall not be liable for any loss, damage, claim, employment outcome, employment-related non-outcome, rejection, reputational harm, lost opportunity, or other consequence arising from the use of AI-assisted content.

Video Content

Profile videos are hosted through third-party video hosting services, including Cloudinary. By uploading a video, you represent that you have the right to share it and that it complies with these Terms.

Videos must not contain nudity, hate speech, harassment, threats, unlawful content, or content that infringes third-party rights. We reserve the right to remove videos that violate these Terms or that we otherwise determine may create legal, security, operational, or reputational risk for the Service.

Employment Applications and Job-Related Features

The Service may include features that help users prepare, organize, share, or submit employment-related information. These features may include profile links, resume-based profiles, application materials, AI-generated content, job application support, employer-facing profile pages, or transmission of user information to third parties.

OpenInterview does not guarantee:

  • That any application will be successfully delivered.
  • That any employer will receive an application.
  • That any employer will review an application.
  • That any employer will respond to an application.
  • That any user will receive an interview.
  • That any user will receive a job offer.
  • That any user will obtain employment.
  • That any application will be submitted before a job posting closes.
  • That any job posting is accurate, available, legitimate, or current.
  • That any application materials will improve a user's chances of employment.

Users remain solely responsible for deciding where to apply, what information to submit, whether submitted information is accurate, and whether to follow up directly with employers or third-party platforms.

Application Transmission and Third-Party System Failures

Where the Service supports transmission of employment-related information, such transmission may depend on third-party systems, including employer websites, job boards, applicant tracking systems, email systems, hosting providers, APIs, browsers, networks, automation tools, or other external services that OpenInterview does not control.

You acknowledge and agree that applications, profile links, resumes, videos, messages, or other employment-related materials may be delayed, blocked, rejected, misdirected, duplicated, corrupted, fail to transmit, fail to display, or fail to be received.

OpenInterview is not responsible for any loss, damage, claim, missed opportunity, lost compensation, lost wages, career impact, or other consequence arising from:

  • A failed application submission.
  • A delayed application submission.
  • An incomplete application submission.
  • A duplicate application submission.
  • An application sent to the wrong destination.
  • An employer not receiving, reviewing, or responding to an application.
  • A job posting expiring, closing, changing, or being removed.
  • Third-party system outages.
  • API failures.
  • Browser or network errors.
  • Automation failures.
  • Hosting failures.
  • Email delivery failures.
  • User-provided errors or omissions.
  • Platform downtime or degraded performance.

Users are solely responsible for confirming application receipt, status, deadlines, and next steps directly with the applicable employer, recruiter, job board, applicant tracking system, or hiring platform.

No Employment Guarantee

OpenInterview.me does not guarantee any employment-related outcome.

Without limitation, OpenInterview does not guarantee:

  • Employment.
  • Interviews.
  • Callbacks.
  • Recruiter responses.
  • Employer responses.
  • Job offers.
  • Compensation levels.
  • Salary increases.
  • Career advancement.
  • Application review.
  • Application acceptance.
  • Employer engagement.
  • Hiring consideration.
  • Successful application delivery.
  • Successful application processing.

Use of the Service does not create any obligation on the part of any employer, recruiter, job board, applicant tracking system, hiring platform, or third party to:

  • Review an application.
  • Respond to an application.
  • Schedule an interview.
  • Conduct an interview.
  • Extend an offer.
  • Hire a user.
  • Provide feedback.
  • Continue a hiring process.

Employment opportunities are influenced by numerous factors outside the control of OpenInterview, including employer preferences, applicant competition, labor market conditions, qualifications, compensation expectations, timing, geographic factors, screening systems, background checks, references, and employer discretion.

Users acknowledge and agree that use of the Service does not increase, guarantee, or otherwise assure any employment-related outcome.

Third-Party Employers, Recruiters, Job Boards, and Listings

The Service may display, reference, link to, receive information from, or transmit information to third-party employers, recruiters, job boards, applicant tracking systems, or hiring platforms.

OpenInterview does not control and is not responsible for:

  • Third-party job postings.
  • Employer communications.
  • Recruiter communications.
  • Hiring decisions.
  • Interview decisions.
  • Compensation decisions.
  • Employment offers.
  • Background checks.
  • Employment eligibility determinations.
  • Job listing accuracy.
  • Job listing availability.
  • Employer conduct.
  • Recruiter conduct.
  • Third-party platform conduct.
  • Fraudulent, expired, inaccurate, misleading, or unavailable job opportunities.

Users are responsible for exercising caution, verifying opportunities, and deciding whether to share personal information with third parties.

User Assumption of Risk

By using the Service, you knowingly and voluntarily assume all risks associated with creating profiles, uploading resumes, generating content, sharing profile links, submitting employment-related information, applying to jobs, interacting with employers or recruiters, and relying on third-party hiring platforms.

You understand that employment searches are uncertain and that missed opportunities, non-responses, rejections, technical failures, inaccurate postings, employer misconduct, and unsuccessful applications may occur.

To the fullest extent permitted by law, you agree that OpenInterview is not responsible for any employment-related result, non-result, loss, damage, or consequence arising from your use of the Service.

Release of Employment-Related Claims

To the fullest extent permitted by applicable law, you release and forever discharge OpenInterview.me, its affiliates, officers, directors, employees, contractors, agents, licensors, service providers, successors, and assigns from any and all claims, demands, causes of action, liabilities, damages, losses, costs, expenses, and attorneys' fees arising out of or related to:

  • Any job application submitted, transmitted, generated, facilitated, or supported through the Service.
  • Any failure to submit, transmit, deliver, process, or receive a job application.
  • Any employer's decision to interview, not interview, hire, not hire, reject, or otherwise evaluate you.
  • Any communication or lack of communication from an employer, recruiter, job board, applicant tracking system, or hiring platform.
  • Any compensation, salary, benefits, employment terms, or employment conditions offered or not offered by an employer.
  • Any technical failure, outage, delay, interruption, error, or malfunction affecting employment-related features.
  • Any AI-generated, AI-assisted, user-generated, imported, parsed, summarized, or reformatted content.
  • Any expired, inaccurate, fraudulent, unavailable, or misleading job opportunity.
  • Any employment-related loss, damage, setback, missed opportunity, or adverse outcome.

You acknowledge that OpenInterview does not control employers, recruiters, applicant tracking systems, job boards, or hiring platforms and cannot influence their decisions or actions.

SMS Opt-In

Providing your phone number and opting in to SMS notifications is entirely optional and is not required to use any feature of the Service. If you opt in, you will receive transactional messages only, such as interview requests, scheduling confirmations, booking confirmations, reminders, scheduling changes, or account-related transactional notifications.

You may opt out at any time by replying STOP. You may reply HELP for assistance. Message frequency varies. Message and data rates may apply. See our SMS Consent page for full details.

Payment and Subscriptions

Some features of the Service may require a paid subscription or one-time payment. Fees are displayed at checkout and are billed in advance. Payments are processed securely by Stripe or another authorized payment processor.

You may cancel your subscription at any time where subscriptions are offered. Cancellation takes effect at the end of the current billing period unless otherwise stated. We do not offer refunds for partial billing periods except where required by applicable law or expressly stated in writing.

OpenInterview does not guarantee any employment outcome, application result, interview, job offer, or compensation result in exchange for payment.

Prohibited Uses

You agree not to use the Service to:

  • Scrape, crawl, harvest, or extract data from the Service without permission.
  • Interfere with or disrupt the integrity, security, or performance of the Service.
  • Attempt to gain unauthorized access to any portion of the Service.
  • Use the Service for any unlawful, deceptive, discriminatory, or fraudulent purpose.
  • Impersonate another person, employer, recruiter, company, or entity.
  • Submit false, misleading, or unauthorized employment-related information.
  • Upload malicious code, viruses, or harmful files.
  • Violate the rights of any third party.
  • Use the Service to harass, threaten, discriminate against, or harm another person.
  • Misrepresent your qualifications, work authorization, identity, credentials, or employment history.

Termination

We reserve the right to suspend, restrict, or terminate your account or access to the Service at any time for violation of these Terms or for any other reason at our sole discretion, including to protect users, employers, third parties, the platform, or our business.

You may delete your account at any time from your account settings where available. Upon termination, your right to use the Service ceases immediately.

Sections that by their nature should survive termination will survive, including ownership provisions, disclaimers, limitations of liability, indemnification obligations, and dispute-related provisions.

Indemnification

You agree to defend, indemnify, and hold harmless OpenInterview.me, its affiliates, subsidiaries, officers, directors, employees, contractors, agents, licensors, service providers, successors, and assigns from and against any and all claims, demands, actions, proceedings, investigations, liabilities, damages, judgments, settlements, penalties, fines, losses, costs, expenses, and attorneys' fees arising out of or related to:

  • Your use of the Service.
  • Your account.
  • Your profile content.
  • Your uploaded content.
  • Your resume content.
  • Your videos.
  • Your application materials.
  • Your communications with employers, recruiters, or third parties.
  • Information submitted through the Service.
  • AI-generated content that you approve, edit, share, publish, or submit.
  • Your violation of these Terms.
  • Your violation of applicable laws or regulations.
  • Your infringement of any intellectual property rights.
  • Your infringement of privacy, publicity, contractual, or other rights.
  • Misrepresentations made by you.
  • Fraudulent information submitted by you.
  • Employment-related claims arising from your activities.
  • Disputes between you and employers.
  • Disputes between you and recruiters.
  • Disputes between you and third-party platforms.

OpenInterview reserves the right, at its own expense, to assume exclusive defense and control of any matter subject to indemnification. You agree to cooperate fully in the defense of any such matter.

Your indemnification obligations survive termination of your account, termination of these Terms, and cessation of your use of the Service.

Binding Arbitration and Class Action Waiver

Agreement to Arbitrate

To the fullest extent permitted by applicable law, you and OpenInterview.me agree that any dispute, claim, controversy, or cause of action arising out of or relating to the Service, these Terms, your account, your use of the Service, employment-related activities, profile content, application submissions, AI-generated content, privacy practices, payments, subscriptions, communications, or any other interaction with OpenInterview.me shall be resolved exclusively through final and binding individual arbitration, rather than in court.

This agreement to arbitrate applies to all claims, whether based on contract, tort, negligence, fraud, misrepresentation, statute, regulation, common law, equity, or any other legal theory.

Informal Resolution Requirement

Before initiating arbitration, either party must first provide written notice of the dispute and allow the other party thirty (30) days to attempt to resolve the matter informally.

Notices to OpenInterview.me must be sent to the contact information listed in these Terms.

Individual Arbitration Only

Any arbitration shall be conducted solely on an individual basis.

Neither you nor OpenInterview.me may bring claims as a plaintiff, claimant, class representative, private attorney general, or member of any class, collective, consolidated, representative, or mass action proceeding. The arbitrator shall have no authority to hear, arbitrate, or resolve any class, collective, representative, coordinated, or consolidated claims.

Class Action Waiver

You expressly waive any right to participate in:

  • A class action lawsuit.
  • A class arbitration.
  • A representative action.
  • A private attorney general action.
  • A collective action.
  • A mass arbitration proceeding.
  • Any proceeding in which claims are combined with those of other users.

All disputes must be brought solely in your individual capacity.

Jury Trial Waiver

To the fullest extent permitted by law, you and OpenInterview.me knowingly and voluntarily waive any right to a trial by jury for any dispute arising out of or relating to the Service.

Arbitration Rules

Any arbitration shall be administered by a nationally recognized arbitration provider selected by OpenInterview.me and conducted under the provider's applicable consumer arbitration rules then in effect. The arbitration may be conducted remotely, by written submission, by telephone, by video conference, or in person as determined by the applicable arbitration rules and the arbitrator.

Exceptions

Nothing in this section prevents either party from:

  • Seeking temporary injunctive relief.
  • Seeking equitable relief related to intellectual property rights.
  • Filing qualifying claims in small claims court where permitted by law.

Severability of Arbitration Provision

If any portion of this Arbitration and Class Action Waiver section is found unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

If the Class Action Waiver is found unenforceable with respect to a particular claim, then that claim shall proceed in a court of competent jurisdiction and all remaining claims shall remain subject to arbitration.

Survival

This Arbitration and Class Action Waiver section shall survive termination of your account, termination of these Terms, and cessation of your use of the Service.

Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise.

To the fullest extent permitted by law, OpenInterview disclaims all warranties, including warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, availability, reliability, and uninterrupted operation.

OpenInterview does not warrant that:

  • The Service will be uninterrupted, secure, timely, accurate, complete, or error-free.
  • Profiles, resumes, videos, applications, or other materials will be displayed, transmitted, received, reviewed, or accepted.
  • AI-assisted content will be accurate, complete, appropriate, or suitable for any particular purpose.
  • Any job application will be successful.
  • Any employer will respond, interview, hire, or offer employment.
  • Any job posting, employer, recruiter, or third-party opportunity is legitimate, current, accurate, or available.
  • Any defects or errors will be corrected.

Your use of the Service is at your sole risk.

Limitation of Liability

To the fullest extent permitted by applicable law, OpenInterview.me and its affiliates, officers, directors, employees, contractors, agents, licensors, service providers, successors, and assigns shall not be liable for any indirect, incidental, special, consequential, exemplary, enhanced, or punitive damages, including lost profits, lost wages, lost compensation, lost employment opportunities, lost data, loss of goodwill, reputational harm, emotional distress, or other intangible losses arising out of or related to your use of, or inability to use, the Service.

Without limiting the foregoing, OpenInterview shall not be liable for any claim, loss, damage, or consequence arising from or related to:

  • Employment decisions.
  • Hiring decisions.
  • Non-hiring decisions.
  • Interview outcomes.
  • Rejected applications.
  • Lost employment opportunities.
  • Missed interviews.
  • Lost wages or compensation.
  • Career setbacks.
  • Employer conduct.
  • Recruiter conduct.
  • Job board conduct.
  • Applicant tracking system conduct.
  • Application delivery failures.
  • Delayed, incomplete, duplicate, corrupted, or failed submissions.
  • Technical outages.
  • AI-generated or AI-assisted content.
  • Third-party platform failures.
  • User errors, omissions, or inaccurate information.
  • Expired, inaccurate, fraudulent, or unavailable job postings.

This limitation applies whether the claim is based on warranty, contract, tort, negligence, strict liability, statute, or any other legal theory, even if OpenInterview has been advised of the possibility of such damages.

To the fullest extent permitted by law, OpenInterview's total aggregate liability for all claims arising out of or relating to the Service shall not exceed the greater of one hundred dollars ($100) or the amount paid by you to OpenInterview during the twelve (12) months immediately preceding the event giving rise to the claim.

Some jurisdictions do not allow certain limitations of liability, so some of the above limitations may not apply to you.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to its conflict of law provisions. Any disputes arising under these Terms shall be resolved in the courts of Delaware.

Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable, the remaining provisions shall remain in full force and effect to the maximum extent permitted by law.

Entire Agreement

These Terms, together with the Privacy Policy, SMS Consent Policy, and any additional policies incorporated by reference, constitute the entire agreement between you and OpenInterview.me concerning the Service and supersede all prior agreements, understandings, and communications relating to the Service.

Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by updating the "Last updated" date at the top of this page. Continued use of the Service after changes constitutes acceptance of the revised Terms.
